Terms of sale

Each purchase the Customer makes on LaCave Wine Store through the website www.lacavestore.com implies their acceptance of the following Terms and Conditions of Sale. These Terms and Conditions of Sale govern the offer and sale of products through the website www.lacavestore.com (“Site”).

Pursuant to Article 7 of Law No. 189 of November 8, 2012, converting Decree-Law No. 158 of September 13, 2012, the sale of products on the Site is reserved for adults only. Orders may only be delivered to individuals who can prove they are of legal age, and delivery to P.O. boxes is not allowed.

The Site is owned by the company m&l di Manuela Lanzone, which also holds the rights to the domain name.

The products sold on the Site, such as wine bottles, accessories, and other typical food products ("Products"), as well as the services offered, are sold by the company m&l di Manuela Lanzone, with registered office at Piazzetta della Vecchia Segheria 1, 12046, Montà (CN), registered with the Cuneo Business Register under number 03441210048, REA number CN 291013 - VAT and tax code 03441210048.

Scope of These Terms

The offer and sale of Products on the Site constitute a distance contract governed by Articles 49 and following of Legislative Decree No. 206 of September 6, 2005 ("Consumer Code") and by Legislative Decree No. 70 of April 9, 2003, concerning electronic commerce regulations.

These Terms and Conditions of Sale apply to all sales made by LaCAVE Wine Store through the Site.

The General Terms and Conditions of Sale may be amended at any time. Any changes and/or new terms will be effective from the moment they are published on the Site in the "Terms of Sale" section. Users are therefore encouraged to regularly access the Site and consult the most up-to-date version of the General Terms and Conditions of Sale before making any purchases.

The Terms and Conditions of Sale applicable are those in force on the date the purchase order is submitted.

These General Terms and Conditions of Sale do not govern the sale of products and/or the provision of services by third parties other than LaCAVE Wine Store, who may be present on the Site via links, banners, or other hypertext connections. Before carrying out commercial transactions with such parties, users should verify their terms of sale. LaCave Wine Store is not responsible for the provision of services and/or the sale of products by such third parties. LaCave Wine Store does not conduct any control and/or monitoring of websites accessible via such links. Therefore, LaCave Wine Store is not responsible for the content of these websites nor for any errors and/or omissions and/or legal violations they may contain.

Nature of goods

All products and services offered for sale on www.lacavestore.com are those described on the pages of the Site, where the name and any accompanying description include the essential characteristics of the goods. This information may be subject to changes or updates in order to improve the service provided to consumers.

Each product is accompanied by an information sheet indicating its main features as well as the price inclusive of VAT ("Product Information Sheet").

Each product available for sale on www.lacavestore.com is associated with a photograph that aims to reproduce the characteristics of the product as accurately as possible. Due to packaging changes by the manufacturer, in some cases the photographs may not exactly reflect the appearance of the delivered product. In particular, with regard to the product vintage, the reference is the information stated in the Product Information Sheet.

Moreover, the images of the products may differ from the actual products due to the settings of the computer systems or devices used by users to view them. These images should therefore be considered as indicative and within the limits of standard tolerance. For the purposes of the purchase contract, the product description provided in the Product Information Sheet shall prevail.

 

Prices and Products availability

The prices published on the Site always include VAT and may be subject to periodic changes without notice. In addition to the product price, any applicable shipping costs, customs duties, or cash-on-delivery fees must also be added. The final price of the purchased goods is the one summarized in the order form at the end of the purchase process.

If a Product is offered on the Site at a discounted price, the Product Information Sheet will indicate: (i) the full reference price from which the discount is calculated, and (ii) what that reference price corresponds to. It is understood that discounted offers will be made only if the full reference price reflects the actual market price of the Product.

If a product is mistakenly listed on the Site at an incorrect price, LaCave Wine Store reserves the right to cancel the sale.

The actual availability of a product may be approximate, as multiple users might purchase it at the same time. In the event a product is no longer available, LaCave Wine Store will contact you promptly via email.
  

Informations regarding the Conclusion of the Contract 

In accordance with Legislative Decree No. 70 of April 9, 2003, concerning electronic commerce, LaCave Wine Store informs the customer that:

  1. in order to complete the purchase of one or more Products on the Site, the customer must fill out an electronic order form and submit it online, following the instructions provided on the Site at each step;
  2. the contract is concluded when the order form reaches the LaCaveStore server
  3. before submitting the order form, the customer will have the opportunity to identify and correct any data entry errors by following the instructions on the Site;
  4. once the order form has been registered, the customer will receive a confirmation email (sent to the email address provided during Site registration) containing: a summary of the general and specific conditions applicable to the contract, information about the essential characteristics of the purchased product, a detailed indication of the price, the payment method used, delivery charges, and any additional costs, as well as standard instructions on the right of withdrawal and a withdrawal form;
  5. the order form will be stored in LaCAVE Wine Store’s database for the time necessary to process the order and, in any case, in accordance with applicable legal requirement

Purchases on the Site may only be made by individuals of legal age.

    Orders/Billling

    Only orders placed through the Site will be accepted. The customer may contact LaCave Wine Store by email, fax, or telephone solely to obtain information regarding the Products and/or their terms of sale through the Site.

    “Shipping” refers to the delivery of the Product by LaCave Wine Store to the courier.

    The Product will be shipped only after confirmation has been received of the successful payment of the total amount due, which includes the Product price, any applicable delivery charges, and any other additional costs, as indicated in the order.

    If the customer has selected credit card, PayPal, or bank transfer as the payment method and the payment is not confirmed, or if the customer has chosen cash on delivery and does not have the Total Amount Due available in cash at the time of delivery by the courier, the purchase contract shall be considered legally terminated pursuant to Article 1456 of the Italian Civil Code. The customer will be notified by email of the termination of the contract and the consequent cancellation of the order.

    In the order confirmation email, in addition to the details mentioned above, the customer will also find the order number, which must be used in any future correspondence with LaCave Wine Store, as well as the shipping and billing address.

    Delivery of Goods 

    Delivery normally takes place within 24–48 hours in Italy. Different timelines apply for deliveries to islands and outside the national territory. Delivery times are indicative and non-binding, and unless otherwise stated, are calculated from the date the order is submitted.

    Shipping rates are detailed on the Shipping page. The total shipping cost is clearly and separately indicated (in Euros, inclusive of VAT) on the Product Information Sheet, in the order summary, and in the order confirmation email, before the customer completes the purchase.

    Shipping is free for orders over €115.00, or any other amount indicated on the Product Information Sheet.

    LaCAVE Wine Store ensures the use of appropriate packaging based on the type of products being delivered. In the case of homogeneous shipments from the same producer or mixed selections, LaCave Wine Store reserves the right to use the producer’s original packaging.

    The Customer is responsible for the accuracy and completeness of the delivery information provided and must include any details that may facilitate delivery (e.g., phone number, name on the intercom, delivery time preferences). LaCave Wine Store is not liable for any delivery errors resulting from inaccuracies or omissions by the customer at the time of order confirmation.

    If the customer is absent at the time of delivery, the courier will leave a notice to arrange a second delivery attempt or allow pickup from the nearest depot. If the customer cannot collect the Product personally, they may authorize another person in writing. The written authorization must include a copy of both the customer’s and the delegate’s ID.

    If the customer is also absent at the agreed date and time for the second delivery attempt, the Product will be placed in storage. LaCave Wine Store will email the customer to resolve the storage status and arrange delivery as soon as possible. If needed, Customer Service may agree with the customer to modify the shipping address.

    If this additional attempt also fails or if the customer does not respond to contact attempts, the Product will be returned to LaCave Wine Store. In any case, 10 working days after the first delivery attempt, the sales contract will be considered terminated and the order cancelled pursuant to Article 1456 of the Italian Civil Code.

    LaCave Wine Store will refund the Total Amount Paid within 15 working days of contract termination, minus any failed delivery costs, return shipping fees, and any other expenses incurred due to the customer’s failure to accept delivery. The termination and refund details will be communicated via email.

    If, before 30 working days have passed, the customer requests the Product to be delivered again, LaCave Wine Store will proceed with a new delivery, subject to the customer being charged the new delivery fee, return shipping costs, and storage fees.

    The customer acknowledges that collecting the Product is a contractual obligation arising from the purchase agreement.

    At the time of delivery, the customer must check the number of Products received and inspect the packaging for any damage or tampering that may suggest the contents were damaged. Any such anomalies should be noted on the courier's delivery slip.

    If the package is clearly damaged or tampered with, the customer must refuse the delivery, noting "GOODS WITH DAMAGED PACKAGING" on the delivery document, and must promptly notify LaCAVE Wine Store.

    This is without prejudice to the customer’s rights under applicable withdrawal and legal warranty regulations.

    If the package appears intact, the customer may accept it by writing "ACCEPTED WITH RESERVATION FOR INSPECTION" on the delivery document. In this case, the customer may inspect the goods later and report any damage to LaCAVE Wine Store within 8 working days.

    Pursuant to Article 1698 of the Italian Civil Code, accepting the goods without reservation waives any claims arising from the transport contract—such as loss or damage—unless due to fraud or gross negligence, or unless the damage or partial loss was not visible at delivery. In such cases, the damage must be reported as soon as discovered, but no later than eight working days after receipt.

    Upon dispatch of the Product (i.e., delivery to the courier), LaCave Wine Store will send the customer a shipment confirmation email.

    Deliveries will be made by a courier appointed by LaCave Wine Store, Monday to Friday, between 9:00 a.m. and 5:00 p.m., excluding national holidays.

    The courier is not authorized to deliver Products to minors or to individuals who cannot present valid identification.

    Customers are encouraged to provide, on the “Addresses” page during checkout, all delivery information required by the courier. LaCave Wine Store declines any responsibility for delivery errors due to customer-provided inaccuracies or omissions.

    If the purchased Product is not delivered or is delivered late compared to the estimated delivery times shown during checkout or in the order confirmation, the customer, under Article 61 of the Italian Consumer Code, may require LaCAVE Wine Store to make the delivery within an additional appropriate period (“Supplementary Period under Article 61(3) of the Consumer Code”).

    If the Product is still not delivered after this Supplementary Period, the customer may terminate the contract (“Termination under Article 61(3) of the Consumer Code”) and may also seek compensation for damages.

    The customer is not required to grant a Supplementary Period if:

    • LaCave Wine Store explicitly refuses to deliver the Product;

    • Timely delivery was considered essential, based on circumstances;

    • The customer informed LaCAVE Wine Store in advance that delivery by or on a specific date was essential.

    In these exceptional cases, the customer is entitled to immediate contract termination and compensation for damages.
    The customer must notify LaCAVE Wine Store promptly of the Supplementary Period or contract termination.
    Upon valid termination, LaCAVE Wine Store must refund the Total Order Amount.

    If the customer does not specify a Supplementary Period or pursue contract termination (without prejudice to the right to do so at any time), LaCave Wine Store agrees to:

    1. Promptly notify the customer by email of the delay (“Delay Notification Email”), indicating a new estimated delivery date if possible (“New Delivery Date”);

    2. If the Product is delivered 1–3 business days after the New Delivery Date, reimburse shipping costs upon request (or waive them if unpaid), within 10 business days;

    3. If delivery occurs 4–10 business days after the New Delivery Date, allow the customer to:

      • Refuse the Product, terminate the contract, and receive a full refund within 10 business days of the termination request;

      • Or, if the customer does not terminate, request a reimbursement or waiver of shipping fees within 10 business days.

    For Multiple Orders involving separately shipped Products, these rules apply to each individual shipment.
    If no Delay Notification Email or New Delivery Date is provided, deadlines are counted from the original expected delivery date. 
    The customer must promptly confirm acceptance of any proposed new delivery date.
    Where a refund is due, the refund amount and method (same as the original payment method) will be communicated via email. Refund timing may vary depending on the customer’s bank, credit card provider, or payment solution used. For cash on delivery orders, the refund will be issued by bank transfer to the account details provided by the customer.

    Direct pickup or Pickup via Customer's courier

    In the event that the Customer collects the ordered products directly or through their own courier, it shall be the Customer’s responsibility to make any necessary reservations, claims, or actions against the courier, as LACave Wine Store shall not, under any circumstances, be held liable for any shortages, damages, losses, or deterioration occurring after the goods have been handed over to the courier.

    Payment Methods

    The payment methods and applicable rules are detailed in the “Secure Payments” section of the Website.

    The payment for Products purchased on the Website can be made via credit card, PayPal, bank transfer, or cash on delivery. The payment methods actually available to the customer are clearly indicated during the purchase process.

    The invoice may be issued after the delivery of the goods, within the time limits provided by law, and will be sent via email. The invoice will be based on the information provided by the customer at the time the order is submitted via the Website, and the customer guarantees that such information is truthful. No changes can be made to the invoice once it has been issued.

    Credit cards accepted by LaCave Wine Store include Mastercard, Maestro, Visa, and Visa Electron. Payments are processed through a secure server-to-server connection using SSL encryption. During the purchase process, credit card data will not be visible and will not be stored in any way. These data will be transmitted directly, via a secure connection, to the banking institution managing the transaction.

    In the case of payment by credit card, the Total Amount Due will be charged at the time the order is submitted.

    To ensure the security of payments made on the Website and to prevent potential fraud, LaCave Wine Store reserves the right to request the customer, via email, to send a front and back copy of a valid ID by the same means. While waiting for the requested document, the order will be suspended. The customer is required to send the requested documents. If the customer fails to send the documents within the specified timeframe, or sends expired or invalid documents, the contract will be considered automatically terminated pursuant to Article 1456 of the Italian Civil Code, and the order consequently cancelled.

    The termination of the contract will result in the cancellation of the order and the refund of any Total Amount Due already paid by the customer.

    If the customer chooses PayPal as the payment method, they will be redirected to the website www.paypla.com where the payment for the Products will be made according to PayPal’s procedures and terms and conditions as agreed upon between the customer and PayPal. The data entered on PayPal's website will be processed directly by PayPal and will not be transmitted to or shared with LaCave Wine Store. Therefore, LaCave Wine Store does not have access to and does not store any credit card data linked to the customer’s PayPal account or any other payment method connected to that account.

    In the case of payment by credit card, if the contract is terminated and the order is cancelled, the cancellation of the payment transaction and refund of the amount will be handled by the bank. Refund processing times depend solely on the banking system. Under no circumstances shall LaCave Wine Store be held liable for any direct or indirect damage resulting from delays in the refund caused by the banking system.

    For payments via PayPal, the Total Amount Due will be charged by PayPal at the time the online contract is concluded. If the purchase contract is terminated and the order is cancelled (or in any other case where a refund is due), the Total Amount Due will be credited back to the customer’s PayPal account. The time required to credit the payment method linked to that account depends solely on PayPal and the banking system.

    If the customer chooses bank transfer as the payment method, once the order is received, LaCave Wine Store will email the customer the bank details and the deadline by which the bank transfer must be made.

    For payments via bank transfer, delivery times will begin from the date LaCave Wine Store receives the transfer.

    To facilitate matching the bank transfer to the order placed, the customer is asked to include the following in the transfer’s payment description:

    (i) the order reference number;

    (ii) the date the order was placed;

    (iii) the first and last name of the order’s account holder, if different from the name on the bank account from which the transfer originates.

    In the case of bank transfer payment, the customer must complete the payment within 15 business days from the date the purchase order was submitted. If not, the contract will be automatically terminated pursuant to Article 1456 of the Italian Civil Code and the order consequently cancelled.

    Right of Withdrawal

    Purchases on LaCaveWineStore.com are subject to the provisions of Legislative Decree 206 of 2005, which guarantees the Customer the right to withdraw ("Right of Withdrawal").

    This right may be exercised no later than 14 calendar days from the date the Products are received (“Withdrawal Period”). To exercise the Right of Withdrawal, the Customer must notify their decision to withdraw before the expiry of the Withdrawal Period.

    To exercise this right, the Customer must send a written communication before the Withdrawal Period expires:

    (a) by requesting and using the Withdrawal Form via email;

    (b) or by submitting any other explicit declaration of their decision to withdraw from the contract ("Withdrawal Declaration"), indicating the order number, the Product(s) for which they intend to exercise the right of withdrawal, and their address.

    The Withdrawal Form or Withdrawal Declaration must be sent by email to: [email protected]

    The Customer agrees to return the products intact, unaltered, and in their original packaging.

    Return shipping costs are the responsibility of the Customer.

    For damaged or altered products, the right of withdrawal cannot be exercised. In such cases, the procedures outlined in the “Shipping” section of these Terms and Conditions must be followed.

    The products subject to withdrawal must be returned at the Customer's expense to LaCave Wine Store within 14 calendar days from the withdrawal notification. The products must be properly protected, packaged, and shipped to the following address:

    Direct return shipping costs are borne by the Customer. The Standard Instructions on Withdrawal, containing information on the right of withdrawal, are available to Customers on the Website at the “Right of Withdrawal” page.

    We will refund the total amount paid by the Customer for the products subject to withdrawal within 14 calendar days of receiving the goods. This refund does not include shipping costs, in accordance with Article 5 of Legislative Decree No. 185 of 22/05/1999.

    The Customer is solely responsible for any decrease in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the Product. The Product must be kept, handled, and inspected with due care and must be returned intact, complete in all its parts, fully functional, with all accessories and instruction leaflets, and with all identification tags, labels, and single-use seals (where present) still attached, intact, and not tampered with. It must also be perfectly suitable for its intended use and free from signs of wear or dirt. Withdrawal must apply to the entire Product. It may not, therefore, be exercised in relation to parts and/or accessories (that are not autonomous Products) of the Product.

    Customers are reminded that, pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded, among other cases, when the sale involves:

    (i) goods made to measure or clearly personalized;

    (ii) products likely to deteriorate or expire rapidly;

    (iii) alcoholic beverages whose price was agreed at the time of contract conclusion, whose delivery can only occur after thirty days, and whose actual value depends on market fluctuations that cannot be controlled by LaCave Wine Store;

    (iv) sealed audio or video recordings, or sealed computer software, which have been opened by the consumer after delivery;

    (v) newspapers, periodicals, or magazines.

    If the right of withdrawal has not been exercised in accordance with the applicable regulations, it will not result in the termination of the contract and, therefore, no refund will be issued.

    In general, for anything not expressly stated, the laws governing distance contracts shall apply. Any disputes shall fall under the jurisdiction of the Italian courts.

    Legal warranty of conformity. Manufacturer warranties

    All products sold on the Website are covered by the Legal Warranty of Conformity as provided for by Articles 128–135 of the Italian Consumer Code (“Legal Warranty”).

    The Legal Warranty is reserved for consumers and therefore applies only to users who purchase on the Website for purposes unrelated to any business, commercial, craft, or professional activity they may carry out.

    LaCave Wine Store (“Seller”) is liable to the customer for any lack of conformity existing at the time of delivery of the product and which becomes apparent within two years from that delivery. The lack of conformity must be reported to the seller within two months from the date it is discovered, or the warranty will no longer be valid.

    Unless proven otherwise, any lack of conformity that appears within six months of product delivery is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the product or the defect. From the seventh month onward, it will be the customer's responsibility to prove that the defect already existed at the time of delivery.

    To benefit from the Legal Warranty, the customer must be able to prove the date of purchase and delivery of the item. It is therefore recommended that the customer keeps a copy of the purchase invoice for this purpose.

    A product has a lack of conformity when it:

    (i) is not suitable for the purposes for which goods of the same type are normally used;

    (ii) does not match the description given by the seller or does not have the qualities of the sample or model presented to the customer;

    (iii) does not have the quality and performance normally expected of a product of the same type, taking into account also public statements made in advertising or labeling;

    (iv) is not suitable for the specific use intended by the customer, which was made known to the seller at the time of the contract and accepted by the seller.

    Therefore, any defects caused by accidental damage, customer misuse, or use not in accordance with the product's intended purpose are excluded from the scope of the Legal Warranty.

    If a lack of conformity is duly reported within the time limits, the customer is entitled to:

    (i) primarily, a free repair or replacement of the product, at their choice, unless the requested remedy is objectively impossible or excessively burdensome compared to the other;

    (ii) secondarily (i.e. if repair or replacement is impossible or excessively burdensome, or not carried out within a reasonable time, or if previous attempts have caused considerable inconvenience to the customer), a reduction in price or termination of the contract, at their choice.

    A remedy is considered excessively burdensome if it imposes unreasonable costs on the seller in comparison to alternative remedies, taking into account:
    (i) the value the item would have if there were no lack of conformity;
    (ii) the significance of the defect;
    (iii) whether an alternative remedy can be provided without significant inconvenience to the customer.

    If a product purchased on the Website shows what may be a lack of conformity during the validity of the Legal Warranty, the customer should contact LaCave Wine Store at [email protected].

    The product in question must be returned to LaCave Wine Store for verification. The direct costs of returning the product are the responsibility of the customer.

    LaCave Wine Store reserves the right to ask the customer to attach the purchase invoice or any other document proving the date of purchase and/or delivery.

    Depending on their nature, products sold on the Website may also be covered by a conventional warranty issued by the manufacturer (“Manufacturer’s Warranty”). The customer may enforce this warranty only against the manufacturer. The duration, scope (including territorial), conditions, procedures, types of defects covered, and any limitations of the Manufacturer’s Warranty are defined by each manufacturer and are typically detailed in the warranty certificate included in the product packaging.

    The Manufacturer’s Warranty is voluntary in nature and does not replace, limit, prejudice, or exclude the Legal Warranty.

    User responsability

    The customer is required to ensure that the personal data provided during registration on the Website are truthful, complete, and up to date, and to promptly notify LaCave Wine Store of any changes to such data.

    If the customer has provided false information and fails to correct it, LaCave Wine Store reserves the right to cancel the customer's registration on the Website and may also refuse any further registrations or purchase orders from that customer.

    Governing law and Jurisdiction .

    The purchase contract concluded on the Website is governed by Italian law.

    This is without prejudice to the application to users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided by the law of the country in which they habitually reside—particularly in relation to the period for exercising the right of withdrawal, the period for returning Products in the event of withdrawal, the procedures and formalities for communicating such withdrawal, and the legal guarantee of conformity.

    For any dispute relating to the application, execution, or interpretation of these General Terms and Conditions of Sale, the competent court shall be that of the place where the customer resides or has elected domicile, if the customer is a consumer.

    Customers residing in a member state of the European Union other than Italy may also access—for any dispute relating to the application, execution, or interpretation of these General Terms and Conditions of Sale—the European Small Claims Procedure, established by Regulation (EC) No. 861/2007 of the Council of 11 July 2007, provided that the value of the claim does not exceed EUR 2,000, excluding interest, fees, and expenses.     Discount Voucher Policy 

    Discount vouchers are alphanumeric codes that, when entered on the Website at the time of payment for an order, entitle the user to the discount associated with the code, subject to the limits described for each individual discount code. In any case, discount codes can only be used for purchases of Products on the Website and upon prior registration by the customer on the Website. Discount codes may be distributed by LaCave Wine Store to its actual or potential customers for promotional or commercial purposes, in electronic or paper form.

    Subject to compliance with applicable personal data protection regulations and in accordance with them, discount codes may be distributed through various means, including:

    • via email as part of direct marketing campaigns

    • through paper media (discount coupons)

    The amount and expiration date of the discount voucher will always be clearly indicated alongside the alphanumeric code communicated. Discount codes must be used within the expiration date. After this date, the discount code can no longer be used and the holder cannot request a replacement with another code with a longer validity period.

    If the value of the discount code is less than the total order amount, the remaining balance may be paid using the payment methods available on the Website. Discount codes cannot be combined with each other for a single purchase. Discount codes can also be used to purchase products already on promotion.

    Discount codes can be used for payments of amounts less than their value; in this case, the remaining discount amount will not be refunded or credited and is considered lost. Each discount code can be used for only one purchase. Under no circumstances do discount codes entitle the holder to change or receive change if the purchase amount is less than the discount value.

    Any products for which discount codes cannot be used will be clearly indicated on the Website. Under no circumstances can discount vouchers be converted into cash.
